<p>There is a great deal of very grave discussion about the real estate market in Arizona, but it&#8217;s more about laws of physics and &#8220;what goes up.&#8221; For a couple of decades, Arizona has been a shining star of growth. According to three U.S. government agencies that keep these types of records, in the period 2000-2008, Arizona was 2nd in population growth, 4th in employment growth, and 3rd in growth of personal income. The majority of that growth was decidedly concentrated in the period pre-2006, as the real estate crash began that year in earnest.</p>
<p>There aren&#8217;t any bright spots in charts of various economic and construction activities:</p>
<p>o Construction employment is down 28% from a year ago.<br />
<br />o A chart of delinquency rates is still showing a vertical line rising to 10% of homes for all loan types.<br />
<br />o Foreclosures started are 50% more than the U.S. as a whole.<br />
<br />o The FHFA Home Price Index lists all of the states ranked by performance of home prices, and:</p>
<p>o Arizona is one up from the bottom, with only Nevada faring worse.</p>
<p>o Home prices are down 17.13% in the last year, and 2.11% in the last quarter.</p>
<p>The question of whether we&#8217;ve reached a &#8220;darkest before dawn&#8221; point is open to debate. The Greater Phoenix Blue Chip Panel expects the bottom is here, with a very modest upturn in 2010. Though permits for new homes are expected to rise by 50% in 2010 over 2009, it will still be 85% below the 2005 peak. In one report, Elliott D. Pollack &#038; Company, at ArizonaEconomy.com states that the long term dynamics for Arizona are &#8220;as good as they&#8217;ve ever been.&#8221; Also, if the state&#8217;s tax structure were to be changed to be more friendly to exports, there could be excellent growth for commerce in the future.</p>
<p>Any improvement in the commercial real estate sector would be welcome, as one out of every four feet of office space is expected to be vacant by year end in Phoenix. With a really low absorption rate, commercial construction is not expected to recover for several years with this much inventory sitting empty.</p>
<p>With all of this bad news, there could be some excellent opportunity in Arizona. As the rest of the country seems to be turning the corner much sooner, there may be investors doing well elsewhere who want to gamble on improvement in the next five years in Arizona.</p>

<p>The present real estate market is acting just as it should on the heels of the greatest real estate boom in the last 40 years. There is a long way to fall to get back to &#8220;normal&#8221;.  This falling back into a normal market, coupled with the contraction of the sub-prime mortgage market has the real estate consumer, and many homeowners in a state of fear.  The various media continue to depict a very grim picture of the markets in general without distinguishing between the national market and local markets, such as the Arizona real estate market, with factors unique in the ways of population growth and investor activity.  I have seen numerous articles referring to the sub-prime debacle as a global crisis.  That may be taking it just a bit too far.</p>
<p>The truth is, there is no geopolitical significance to recent events in the U.S. real estate market and the sub-prime crisis.  To rise to a level of significance, an event &#8212; economic, political, or military &#8212; must result in a decisive change in the international system, or at least, a fundamental change in the behavior of a nation.  The Japanese banking crisis of the early 1990s was a geopolitically significant event.  Japan, the second-largest economy in the world, changed its behavior in important ways, leaving room for China to move into the niche Japan had previously owned as the world&#8217;s export dynamo. On the other hand, the dot-com meltdown was not geopolitically significant. The U.S. economy had been expanding for about nine years, a remarkably long time, and was due for a recession.  Inefficiencies had become rampant in the system, nowhere more so than in the dot-com bubble. That sector was demolished and life went on.</p>
<p>In contrast to real estate holdings, the dot-com companies often consisted of no real property, no real chattel, and in many cases very little intellectual property.  It really was a bubble. There was virtually, (pun intended), no substance to many of the companies unsuspecting investors were dumping money into as those stocks rallied and later collapsed. There was nothing left of those companies in the aftermath because there was nothing to them when they were raising money through their publicly offered stocks. So, just like when you blew bubbles as a little kid, when the bubble popped, there was absolutely nothing left. Not so with real estate, which by definition, is real property. There is no real estate bubble!  Real estate ownership in the United States continues to be coveted the world over and local markets will thrive with the Arizona Real Estate market leading the way, as the country&#8217;s leader in percent population growth, through the year 2030.</p>
<p>As for the sub-prime &#8220;crisis&#8221;, we have to take a look at the bigger picture of the national real estate market. To begin with, remember that mortgage delinquency problems affect only people with outstanding loans, and more than one out of three homeowners own their properties debt-free. Of those who have mortgages, approximately 20% are sub-prime. 14.5% of those are delinquent. Sub-prime loans in default make up only about 2.9% of the entire mortgage market. Now, consider that only 2/3 of homeowners have a mortgage, and the total percentage of homeowners in default on their sub-prime loans stands at around 1.9%. The remaining two-thirds of all homeowners with active mortgage prime loans that are 30 days past due or more constitute just 2.6% of all loans nationwide. In other words, among mortgages made to borrowers with good credit at application, 97.4% are continuing to be paid on time.</p>
<p>As for the record jumps in new foreclosure filings, again, you&#8217;ve got to look closely at the hard data. In 34 states, the rate of new foreclosures actually decreased. In most other states, the increases were minor &#8212; except in the California, Florida, Nevada, and Arizona real estate markets. These increases were attributable in part to investors walking away from condos, second homes, and rental houses they bought during the boom years.</p>
<p>Doug Duncan, chief economist for the Mortgage Bankers Association, says that without the foreclosure spikes in those states, &#8220;we would have seen a nationwide drop in the rate of foreclosure filings.&#8221; In Nevada, for instance, non-owner-occupied (investor) loans accounted for 32% of all serious delinquencies and new foreclosure actions. In Florida, the investor share of serious delinquencies was 25%; in Arizona, 26%; and in California, 21%. That compares with a rate of 13% for the rest of the country.  This makes for some great buys for the savvy Arizona real estate investor in the area of short sales, foreclosures, and wholesale properties.</p>
<p>Bottom line: Those nasty foreclosure and delinquency rates you&#8217;re hearing about are for real. But they&#8217;re highly concentrated among loan types, local and regional economies, and investors who got their foot caught in the door at the end of the &#8220;boom&#8221; and are just walking away from those poorly performing properties.  Most of those investors still have homes to live in, maybe more than one.</p>
<p>In the wake of the boom years, we now have a high inventory of homes on the market, Investors and speculators who quickly bought up homes dumped them just as quickly back on the market in hopes of a fast return. The frenzy of investors purchasing homes put pressure on inventories and drove prices up, further increasing investor activity.  Then, as if all at once, many of those investors put their properties on the market, creating an imbalance in the reverse direction. With so many homes on the market, prices began to stall and then fell.  Prices will continue to fall until demand chews up excess inventories.</p>
<p>With investors no longer a big part of housing demand, primary homeowners are slowly chipping away at the existing inventory. The Las Vegas housing market will rebound in March 2008, according to the largest and most respected appraisal firm locally. The main contributing factor to the sooner than later rebound of this southwestern city is a growing population and thriving local economy.</p>
<p>Arizona and Nevada are expected to lead the country in percentage population growth for the next 20-25 years. The population of Arizona is expected to approximately double during that time so we can expect a strong housing demand going forward.  Normal inventory levels for Phoenix real estate are about 6-8 months. Current inventory is about 10-12 months. So, we are not far above &#8220;normal&#8221; inventories in Phoenix. There are, however, outlying cities in this large metropolis that have inventories in excess of 1 year. Queen Creek real estate inventory is the worst with approximately a 2-3 year surplus of homes on the market, mostly due to the large percentage of new homes purchased by investors and then quickly flipped back onto the resale market. Surprise and Peoria real estate markets have a 1-2 year inventory for largely the same reason. We are already seeing some Scottsdale real estate and Paradise Valley real estate prices increase in value. Billions of dollars are being poured into the local economy in the way of commercial development from the downtown area to Northeast Phoenix and Scottsdale.</p>
<p>The demand for Arizona homes will remain strong in years ahead as new populations create the need. The demand for housing across our great nation will remain strong as this next generation of young debutantes steps onto the home buying stage. Interest rates are still at historic lows and the lending institutions will continue to offer creative financing options. Sure, some hedge funds lost the air in their tires, but financing sub-prime loans is a high stakes game for the super rich and is not of geopolitical significance. They will find other ways to lend their billions for huge profits in the wake of this sub-prime debacle. Let&#8217;s not be gripped in the fear created by reports from all media types trying to &#8220;make news&#8221;.  Let&#8217;s face it, the real numbers are not that bloody exciting. Ask yourself, is this an Arizona real estate crisis, or the perfect time to buy an affordable Arizona home? <p>Arizona Mortgage Licensing is one of the most corrupt type of mortgage licensing schemes in the United States. They require a Responsible Individual that must be a resident of Arizona to act as your responsible individual. Since there are not many people that have this type of license, it usually costs about $1,000 to $1,500 per month to hire someone to be your Responsible Individual. If you have the money to spend, this is a great state to originate in.</p>
<p>Certificate of Authority</p>
<p>You are required to register your corporation as a foreign corporation with the state.  This is very tedious because you actually have to file with two different agencies.  Any trade names also need to be filed with the Secretary of State.</p>
<p>Surety Bond</p>
<p>Both the Broker and Banker licenses require that you obtain a surety bond.  The surety bond is needed to protect consumers and third parties from the mortgage companies non-payment.  The surety bond is not an insurance policy so it is required to be paid back if used.</p>
<p>Brick&#8217;n'Mortar (Physical Office in the State)</p>
<p>Arizona does require that you have a physical office in the state in order to obtain a mortgage license, however, the responsible individual usually has a physical location in Arizona that may be used as your physical location.  This location may be the physical location for an unlimited number of companies.</p>
<p>Responsible Individual</p>
<p>The responsible individual as mentioned above is the biggest scam.  I don&#8217;t fault the responsible individuals for this, but the state.  The responsible individual will usually review some of your files on subject properties in Arizona just to cover them in case you are audited, however, the limited number of responsible individuals in the state makes it very costly to hire someone because they can charge a lot for their services</p>
<p>Licensing Application</p>
<p>The license application is fairly extensive and requires personal and company financials.  There are numerous pages of information on the owners, officers, and directors of the company that must be completed. <p>It&#8217;s a seemingly simple question: Where do real estate buyers come from? More complex, however, would be why? Depending on their individual circumstances, they come:</p>
<p>-from all locations &#8211; perhaps from the very same town or maybe even from abroad</p>
<p>-from all stages of life &#8211; they could be a newly-married couple or retirees</p>
<p>-from all walks of life &#8211; maybe the new minister for a local church or a new math teacher at the high school</p>
<p>-for different reasons &#8211; it could be a transferee and his family or a city dweller seeking a home in the peaceful countryside</p>
<p>-with different motivations &#8211; parents aiming to enroll their children in a better school district or a single person looking for an affordable place to call home</p>
<p>-with different needs and wants &#8211; a young couple desiring a family-friendly neighborhood for their children or someone seeking the privacy of a rural setting</p>
<p>-with different expectations &#8211; a first-time homebuyer hoping to enjoy the process of choosing their very first property or a seasoned purchaser who already knows what to expect</p>
<p>Given all of these variables, and their many potential combinations thereof, there is no question that no two buyers are exactly alike. Customers looking for a property are unique and deserve to be regarded as such. Recognizing this is one of the most important qualities of a good real estate agent. An experienced real estate salesperson should start by asking the buyer a number of questions, and there are just as many good reasons for this. One very significant reason is that everyone&#8217;s time is of equal consideration and, in an effort to not waste it, beginning from the point of understanding the buyer goes a long way toward that effort.</p>
<p>Real estate agents in the Hudson Valley work with a vast variety of buyers and, in Orange County, New York, real estate properties in all different price ranges abound. There are &#8220;handyman specials&#8221; in the well under $100,000 range, mini-estates in the over $2,000,000 bracket, and homes priced everywhere in between those two extremes. The majority of buyers enter the marketplace with a good idea of where they want to live, as well as what they are able to comfortably afford. In the event a purchaser is uncertain of either of these, a real estate agent can assist in determining them.</p>
<p>Whatever the price point, there is both a village and a town of Goshen, NY, with an adjoining city of Middletown, NY, where a buyer has tremendous choices in home ownership. In Goshen, for example, there are 139 residential properties for sale, with asking prices of $175,000 all the way up to $2,200,000, with new properties being listed every day now that the Spring market has begun. It would seem impossible for a buyer, who is looking in Goshen, to be unsuccessful in their search for a suitable home. Given the abundant inventory, buyers would first need to narrow down the choices by their price range. The greatest selection occurs in the $300-400,000 range, with all styles of homes available. Buyers who fancy older homes will find an equally pleasing selection &#8211; from a 1747 Colonial listed on the National &#038; State Historic Register, to a 4000 sf Farmhouse built in 1789, to a Queen Anne Victorian with restored vintage features and a custom gourmet kitchen, to an elegant, historically inspired 9800 sf estate with 35 acres, located on a meandering country road on the outskirts of town.</p>
<p>For investors, or do-it-yourself types, there are 58 multi-family properties on the market in Middletown. A buyer would benefit from renting out the units and applying the proceeds to pay the mortgage or, if they prefer, they can reside in one and rent out the other(s). Also popular is &#8220;flipping&#8221;, the process of buying, fixing and re-selling for a profit. For couples and families checking out Middletown, there is everything from a brand new, three-bedroom Colonial for $300,000, to an absolutely charming and huge antique five bedroom Victorian for under $400,000.. With an incredible 162 single family homes on the market in Middletown, the affordability factor is in a buyer&#8217;s favor, since 141 of these properties are listed under $300,000. This location is also a shopping mecca, with just about every imaginable brand-name store available within a couple of miles of each other.</p>
<p>Both locations also offer an awesome array of activities for participation &#8211; museums, parks, historic landmarks, walking and biking trails, recreational offerings such as golf and swimming, festivals, farmers markets, wineries, antique shops, scores of restaurants, diners &#038; cafes, art galleries and more!</p>
<p>No doubt about it &#8211; whether an individual, a couple, a family, a renter or an investor, Goshen, NY and Middletown, NY are great places to live and enjoy life!</p>

<p>Many Real Estate investors I talk with make use of bird dogs. Recently, I ran across several agents who claim to be using them. Bird dogs are usually unlicensed individuals who find deals for the principal in a transaction. Further, investors usually pay bird dogs a finder&#8217;s fee.</p>
<p>So what does the law say about that? Specifically, ARS 32-2101 defines what a &#8220;Real Estate Broker&#8221; does (excerpted):</p>
<p>32-2101. Definitions</p>
<p>In this chapter, unless the context otherwise requires:</p>
<p>47. &#8220;Real estate broker&#8221; means a person, other than a salesperson, who, for another and for compensation:</p>
<p>(a) Sells, exchanges, purchases, rents or leases real estate or timeshare interests.<br />
<br />(b) Offers to sell, exchange, purchase, rent or lease real estate or timeshare interests.<br />
<br />(c) Negotiates or offers, attempts or agrees to negotiate the sale, exchange, purchase, rental or leasing of real estate or timeshare interests.<br />
<br />(d) Advertises or holds himself out as being engaged in the business of buying, selling, exchanging, renting or leasing real estate or timeshare interests or counseling or advising regarding real estate or timeshare interests.<br />
<br />(e) Assists or directs in the procuring of prospects, calculated to result in the sale, exchange, leasing or rental of real estate or timeshare interests.<br />
<br />(f) Assists or directs in the negotiation of any transaction calculated or intended to result in the sale, exchange, leasing or rental of real estate or timeshare interests.<br />
<br />(g) Engages in any of the acts listed in subdivisions (a) through (m) of this paragraph for the sale or lease of other than real property if a real property sale or lease is a part of, contingent on or ancillary to the transaction.</p>
<p>A close reading of this indicates that a broker does pretty much what you expect &#8211; buys and sells or negotiates Real Estate transactions for others. Of particular interest is item (i), which indicates that a broker is also the person who gets leads.</p>
<p>This is important because of the next section (excerpted):</p>
<p>32-2122. License required of brokers and salespersons</p>
<p>A. This article applies to any person acting in the capacity of a:</p>
<p>1. Real estate broker.</p>
<p>B. It shall be unlawful for any person, corporation, partnership or limited liability company to engage in any business, occupation or activity listed in subsection A without first obtaining a license as prescribed in this chapter and otherwise complying with the provisions of this chapter.</p>
<p>C. Any act, in consideration or expectation of compensation, which is included in the definition of a real estate, cemetery or membership camping broker, whether the act is an incidental part of a transaction or the entire transaction, constitutes the person offering or attempting to perform the act of a real estate broker or real estate salesperson, a cemetery broker or cemetery salesperson or a membership camping broker or a membership camping salesperson within the meaning of this chapter.</p>
<p>So this section seems to say that we have to have a license to do anything falling under the definition of &#8220;Broker&#8221;; in particular, we cannot find leads for a principal and be paid for it, unless we are licensed. The law seems pretty black and white on this. So how do investors legally pay bird dogs? My feeling is that in most instances, they just pay them and hope not to get caught.</p>
<p>There are a few ways that a bird dog can be legally paid, however. One way, perhaps the &#8220;cleanest&#8221; way, is for the bird dog to be the initial purchaser of the property; they would write a purchase contract as &#8220;Bird M. Dog and/or assignee&#8221;, and get the contract signed by the seller. Then, the principal would pay the bird dog an assignment fee, purchasing the contract from the bird dog. Nothing wrong with that! However you might want to ask your tax accountant about the implications here &#8211; Is there a step up in the buyer&#8217;s basis as a result of the assignment cost? And what happens with any representations and warranties &#8211; do they flow from the assignor (Bird Dog) to the assignee (Principal) ? Good questions, I do not have the answers.</p>
<p>A second possible way is for the bird dog to again write the contract, but be a direct party to the transaction throughout: &#8220;Bird M. Dog and Joe Principal&#8221; are the purchasers, and a separate compensation agreement between the two can be arranged. The question here is, can a separate compensation agreement be made between the two parties without it being considered a commission? And, is a side agreement really needed &#8211; to make sure that there is no misunderstanding later that Mr. Dog and Mr. Principal are co-tenants?</p>
<p>A third way is for the bird dog and the principal to form a partnership (or LLC or other entity) which is then the purchaser of the property, and the partners share in sales. Perhaps Mr. Dog has to put in $100 as his contribution, and for his work in finding the property, his compensation is the return of his capital plus $1000. Does this work? Maybe, ask a lawyer!</p>
<p>What must happen is that the bird dog needs to be a party to the contract; then they are not &#8220;practicing Real Estate without a license&#8221;, instead they are one of the principals in the deal. But let&#8217;s suppose for a moment that they are not a party, and just get paid. What&#8217;s so bad about this? Is the public really harmed, and, does the State really care? Apparently they do. There was a case where a Real Estate brokerage was paying a monthly fee to a mortgage lender so that the lender would forward all their mortgage leads to the Broker. The fee was not based on whether or not a transaction would close, it was a flat monthly fee. The broker was substantially fined, but not by the State; this was found to be a RESPA violation. RESPA is the Real Estate Settlement Procedures Act, and disallows Real Estate licensees from making payments to unlicensed individuals; the fine is $10,000 per occurrence. So not only can the State go after the recipient of the finder&#8217;s fee for unlicensed activity, but HUD can go after the Principal (if they are licensed). My advice? Make sure your bird dog is on the contract as a principal. Even then, talk to a good attorney and make sure what you are planning is in compliance.</p>

<p>It doesn&#8217;t matter if you want to sell real estate or buy real estate, be an agent or appraiser, purchase a townhouse or add on a den, run a huge real estate company or operate out of your tiny one-car garage, or be someone who just likes reading the words &#8220;real estate!&#8221;  You got to do it with passion.  House hunting can&#8217;t be a lazy thing.  House selling certainly not, either.  Even if you&#8217;re selling a young couple a dirt-cheap fixer-upper.  To them, it may be their very first home and the thing that new marriages and happy dreams are made of.  To them, that run-down piece-of-junk first house is a palace.  And no one lives in a palace without passion!</p>
<p>The father of philosophy, Mr. Aristotle, once remarked, &#8220;Whereas the law is passionless, passion must ever sway the heart of man.&#8221;  And truer words were never spoken about real estate and the real estate market.  Most of all: the real estate profession.  You don&#8217;t find houses to sell.  You find potential buyers&#8211;people&#8211;to sell houses to.  Not the house you want to sell to them.  But the house they want sold to them!  When it&#8217;s done this way then everyone is happy.  For success doesn&#8217;t just breed success.  Success should breed happiness.  If you&#8217;re an unhappy real estate agent then it just very well could be because you&#8217;re not making happy buyers.  It has nothing to do with finding happy buyers.  It&#8217;s making buyers happy.</p>
<p>And this brings me back to the word passion, and to what the 18th Century French philosophy Denis Diderot once said.  If you don&#8217;t remember the now not-to-famous Denis, that&#8217;s okay.  But try to remember these words: &#8220;Only passions, great passions, can elevate the soul to great things.&#8221;   If you aspire to become a great real estate salesman or find yourself longing to purchase a great house to live in, then be passionate about it.</p>
<p>Forget about the real estate deal you have no passion for.  And by all means, don&#8217;t buy a home or piece of property you feel passionless about.  Or work with someone who is clearly a dispassionate buyer or seller.  Even in today&#8217;s tough real estate market both seller and buyer can come away feeling happy in their dealing and in the ending deal.  You must go in with passion, work it with passion, and be passionate about the business as you are about your personal life.</p>
<p>This is what breeds success and happiness.  PASSION!  Mr. Aristotle certainly knew it.  Over 23 hundred years ago.  And if he could sell the whole world on subjects like logic and reason, imagine how things would have gone if he had gotten into real estate.  It would have been he who conquered the known world back in 4th Century B.C.  Not that passionate-about-drinking-wine partying guy and soldier-boy-turned-general named er&#8230;oh yeah, Alexander!</p>

<p>If you have been looking for property in the last few days, then there are chances that you have come across the most confusing terminologies in the Real Estate directory. A Real Estate broker and a Real Estate agent are two terms that you will hear from time to time. But what exactly is the difference between the two? Well for starters, an agent may be a person who works under a registered broker. Or in certain cases, a broker does not have anyone working under him and he prefers to be the agent as well. In most cases the person that you deal with when finalizing Real Estate deals is a Real Estate agent.</p>
<p>A Real Estate broker is its true sense is the party who acts as an intermediary between sellers and buyers of real estate and attempts to find sellers who wish to sell and buyers who wish to buy. A broker is a person with a lot more experience and a lot more knowledge under his belt.</p>
<p>Credentials:-</p>
<p>Both these people have licenses but the realtor/broker has more credentials to his name. The training and the experience that one needs in order to be a realtor is much more when compared to a Real Estate agent. Most realtors are members of an organization called the National Association of Realtors. This is an extremely professional organization which has strict code of ethics. These codes are a way of proving to the public that this is a profession that requires a lot of dedication and integrity. Agents are also required to have certain credentials when it comes to acquiring a license but it is far lesser than a realtor. Confidentiality, obeying property rules, giving priority to the interests of the clients, reporting any issues etc, are some of the obligations of the agent. The broker also follows these regulations but he also follows much more stringent regulations under the NAR.</p>
<p>Which one to choose?</p>
<p>When it comes to finding a property or selling your property, both of them can help you. On many occasions the realtor will hire the agent himself. When this happens, the agent&#8217;s behavior and his performance is the responsibility of the realtor and you no longer have to worry. The agent will follow the high code of ethics that are set by the more experienced realtor. It is also important to mention that each one has its own pros and cons.</p>
<p>Choosing one:-</p>
<p>You can look at certain points before choosing a Real Estate agent or a broker. You need to look at whether the broker is licensed or not. All brokers and agents need to be licensed in the US but the rules may vary for other countries. There are separate registrations and license needed by certain states. Look for listing options, services and selling ideas that they may have. When you have this with you, you can always do a comparison between couple of brokers. Ask for the pricing and the fee structure. Ask them to cover all kinds of charges and fees that may be involved in the transaction. At any point of time during the transaction, if you do not feel comfortable about anything make sure that you negotiate it with the chosen party. The commission, the term of the contract etc are some of the things that can be discussed and negotiated openly.</p>

<p>The vast majority of first time home buyers will work with a real estate professional when they buy their new home. Most of us are not cut out for the immense amount of research, legwork, and paperwork involved with home buying and selling. The advantages of hiring a professional are endless.</p>
<p>However, before signing on with any one individual, it is important for you to learn the differences between the professionals who are available to you. The three individuals we will discuss are agents, brokers, and Realtors. Let us take a look at the different levels of training, knowledge, certification, and experience of each.</p>
<p>Real Estate Agent</p>
<p>Agents are the most general of real estate professionals. Many home buyers will refer to their agent as a Realtor. Technically, the agent may or may not be a Realtor; as we will see below. At this time, we will take a look at an agent who has not yet acquired Realtor status.</p>
<p>Typically, a real estate agent:</p>
<p>- has at minimum a high school diploma and is at least 18 years of age<br />
<br />- completed 30 &#8211; 90 hours of formal training<br />
<br />- passed a written real estate exam<br />
<br />- holds a license to sell real estate in the state where he or she works<br />
<br />- renews the license every year or two<br />
<br />- in some states is required to work under a broker<br />
<br />- does not earn commission directly but receives a cut from commission earned by the brokerage</p>
<p>Broker</p>
<p>A real estate broker is an individual who is qualified to practice real estate independently. Brokers oversee and sponsor the agents who work within their brokerage. Typically a broker does not work with clients directly but plays more of a management and administrative roll. The broker is the name you see on for sale signs around the neighborhood.</p>
<p>To become a broker, an agent:</p>
<p>- completed 60 &#8211; 90 hours of formal training<br />
<br />- passed a more comprehensive exam than the one passed by the agent<br />
<br />- practiced real estate for a defined amount of time; at minimum 1-3 years</p>
<p>Realtor</p>
<p>A Realtor is an agent who is also a member of the National Association of Realtors. Important to note is that the name Realtor is actually trademarked by the NAR. For this reason, it is technically inaccurate to refer to every agent on the street as a Realtor.</p>
<p>A Realtor:</p>
<p>- pledges to uphold NAR&#8217;s organizational ethics code<br />
<br />- often holds multiple designations and certifications<br />
<br />- demonstrates specific skills, performance and knowledge<br />
<br />- has access to advanced education and a wealth of resources</p>
<p>By knowing the differences between a real estate agent, a broker and a Realtor, you can now narrow down the list of the many professionals who are eager to help you find, purchase, and move into your first home.</p>
